Terms of Service

These Terms of Service ("Terms") govern your access to and use of the NutriNex website, applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1) Who we are

NutriNex is a nutrition, health, and appointment management platform operated by Arc Dev ("NutriNex", "we", "us", or "our"). Our contact details are listed at the end of these Terms.

2) Eligibility and accounts

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You agree to provide accurate, current, and complete information and to keep it updated.

3) Service roles

The Service supports different user roles, such as clients, health care professionals ("HCPs"), and practice administrators.

  • If you are a client, your HCP or practice may create or manage parts of your profile to provide services to you.
  • If you are an HCP or practice, you are responsible for your relationship with your clients and for complying with all applicable professional, ethical, and legal obligations.

4) Not medical advice

The Service provides tools for tracking nutrition and health-related data and for coordinating appointments. It does not provide medical advice, diagnosis, or treatment. Always seek the advice of a qualified health professional with any questions you may have. Do not delay or disregard professional advice because of something you read or see in the Service. In an emergency, contact emergency services immediately.

5) Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, or fraudulent purposes.
  • Upload or share content that is illegal, infringing, abusive, or violates privacy or confidentiality.
  • Interfere with or disrupt the Service or its security features.
  • Attempt to gain unauthorized access to accounts, systems, or data.
  • Reverse engineer, decompile, or attempt to extract source code except where permitted by law.

6) Content and data

You retain ownership of your content and data. You grant us a limited, non-exclusive, worldwide license to host, store, and process that content solely to provide and improve the Service and as described in the Privacy Policy.

7) Communications

You may receive service-related communications (such as appointment notifications, account verification, and security alerts). You may opt out of marketing communications, but you cannot opt out of essential service messages.

8) Third-party services

The Service may integrate with or link to third-party services (such as calendar or email providers). Your use of third-party services is governed by their terms and policies, and we are not responsible for their content or practices.

9) Fees and payments

Some features may require payment. If you purchase paid services, you agree to the fees and billing terms presented at the time of purchase. Fees are non-refundable except as required by law or as stated in the applicable purchase terms.

We do not warrant that the Service will be uninterrupted, secure, or error-free.

13) Limitation of liability

To the maximum extent permitted by law, NutriNex and its affiliates, directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or related to your use of the Service.

14) Indemnity

You agree to indemnify and hold harmless NutriNex and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.

15) Changes to the Service or Terms

We may update the Service or these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by posting an updated date or notifying you in the Service. Your continued use of the Service after the effective date of the changes means you accept the updated Terms.

16) Governing law

These Terms are governed by the laws of South Africa. Any disputes will be subject to the exclusive jurisdiction of the courts located in Johannesburg, South Africa, unless applicable law provides otherwise.
